01
About these terms
These terms are an agreement between you and Ossy Technologies Inc., a Canadian corporation with offices at 400-80 Atlantic Ave, Toronto ON M6K 1X9, Canada, which operates as Ossy ("Ossy", "we", "us"). They cover the Ossy service: the Ossy app, your Ossy account and card, the member pages we send you by text, and this website, ossyhq.com. By creating an account or otherwise using Ossy, you agree to them.
Our privacy policy explains how we handle your personal information.
Venues that use Ossy to run their loyalty program and take orders agree to separate merchant terms. These terms cover customers and visitors.
02
What Ossy is
Ossy is one account for the independent cafés, bars and restaurants you go to. Each venue you join runs its own loyalty program through Ossy, with its own points balance and rewards. Where a venue offers it, you can also order ahead from the app.
Your Ossy card is the part of your account you show at the counter. It lives in the app and can be added to wallet apps like Apple Wallet. The card, the app and the member pages all show the same account, so it doesn't matter which one you use.
03
Who can use Ossy
- You need to be at least 14 years old to use Ossy.
- If you're under the age of majority where you live, you need permission from a parent or guardian, and they agree to these terms on your behalf.
- Some rewards and menu items, like alcoholic drinks, are only for people of legal drinking age where the venue is. The venue decides whether you can receive them.
- Ossy is currently available in Canada.
04
Your account
- One account per person. Your phone number is how Ossy knows you, so use a number that belongs to you.
- Staff at a venue can start your account at the counter using your phone number. Only give them your number if you want to join. The account becomes yours when you sign in with that number.
- Keep your details up to date. If you change phone numbers, update it in Ossy so your points stay with you.
- Keep your phone and account secure. You're responsible for what happens on your account, including points and orders, so tell us right away if you think someone else is using it.
05
Points and rewards
- Each venue runs its own program. It decides how points are earned, which rewards it offers and what they cost, and it can change or end its program.
- Points stay with the venue that gave them. They can't be combined across venues, transferred to someone else, sold or exchanged for cash. Points have no cash value.
- Points follow your purchases. Points are added when a purchase is matched to your account. If a purchase is refunded, the points from it are removed. Points added by mistake can be corrected.
- Rewards come from the venue, not Ossy. Questions about a reward or a purchase are best taken to the venue.
- If a venue leaves Ossy or closes, your points there may no longer be usable. We'll let you know when we reasonably can.
- Points earned through fraud, by mistake or by breaking these terms can be removed.
06
Ordering ahead
- The venue makes and sells your order. Ossy passes it to the venue's point-of-sale system. The venue sets its menu, prices, availability and pickup times, and an order is confirmed only once the venue accepts it.
- You pay the venue. Payment is taken by the venue's payment processor. Ossy doesn't hold your money or your card details, and your receipt comes from the venue.
- Problems with an order, like a missing item or a refund, are handled by the venue. Contact them first, and we'll help if you can't reach them.
- Points for an order are added once the venue completes it.
07
Messages
- When you join a venue, we'll text you a link to your account. We also send the messages you need to use Ossy, like a sign-in link or an update on an order. Your carrier's message and data rates may apply.
- We only send offers and news if you've agreed. Reply STOP to any text to stop them.
08
Using the service
- Venue details, like hours, menus and addresses, are provided by the venue and can be out of date. Check with the venue before you go.
- Features change. We're always working on Ossy and may add, change or remove features.
- The Ossy name, logo, app and website belong to us. You can use them to use Ossy, and for nothing else. Venue names and logos belong to the venues.
- What you add, like your name and profile photo, stays yours. You give us permission to store and display it so we can run Ossy for you and show it to the venues you join. Only add content you have the right to use.
09
What's not allowed
When you use Ossy, don't:
- Break the law, or help someone else break it.
- Earn or redeem points dishonestly, such as by using someone else's account or placing orders you don't intend to pick up.
- Harass, threaten or abuse other people, including venue staff.
- Pretend to be someone else, or use a phone number or email that isn't yours.
- Add content that's illegal, hateful or infringes someone else's rights.
- Interfere with Ossy: hack or overload it, scrape it, use bots, or copy or reverse-engineer it.
10
Other services
Ossy works with services run by other companies, such as Apple Wallet, the app stores, and a venue's point-of-sale and payment systems. Their own terms apply when you use them, and we're not responsible for how they work.
11
Closing your account
- You can stop using Ossy at any time. To close your account, email support@ossyhq.com. Your points are lost when your account is closed.
- We may suspend or close your account if you break these terms, if we need to in order to protect other people or Ossy, or if the law requires it. Where appropriate, we'll tell you why.
- If we ever shut Ossy down, we'll give you reasonable notice first.
12
Our responsibilities
- We work hard to keep Ossy running and accurate, but it's provided as is. We can't promise it will always be available or error-free, or that every purchase will be matched to your account.
- Venues are independent businesses. We're not responsible for their products, food, orders, services, premises or rewards.
- As far as the law allows, we're not liable for indirect or consequential losses, and our total liability to you is limited to $100 CAD.
Nothing in these terms limits rights you have under consumer protection laws that can't be waived, including in Quebec.
13
Disputes
If something goes wrong, please email support@ossyhq.com first. Most problems can be sorted out quickly.
These terms are governed by the laws of the province or territory in Canada where you live, and the federal laws of Canada that apply there. You can bring a claim in the courts of that province or territory.
14
Changes to these terms
If we change these terms, we'll post the new version here and update the date at the top. If a change is significant, we'll tell you before it takes effect. If you keep using Ossy after that, you accept the new terms. If you don't agree, you can close your account.
